What This Means (2025 FDD)
According to Bambu's 2025 Franchise Disclosure Document, a franchisee must comply with the terms and conditions of any mandatory product recall promptly upon receiving notice from Bambu. This means that if Bambu issues a product recall, the franchisee is obligated to take immediate action to adhere to the recall's requirements. Failure to comply with a mandatory ingredient or product recall promptly upon receipt of notice from Bambu or public health officials of such recall can be grounds for default under the agreement.
This obligation is significant because it directly impacts the safety and quality standards of the Bambu brand. Franchisees must have systems in place to quickly identify, remove, and replace any recalled products to protect customers and maintain the brand's reputation. This may involve additional training for staff, adjustments to inventory management, and close communication with Bambu and its approved suppliers.
Furthermore, the FDD states that operating the shoppe in a manner that imminently endangers the public health or safety, including failure to comply with product recalls, can lead to termination of the franchise agreement. This underscores the importance of adhering to recall notices and maintaining high standards of safety and compliance within the Bambu franchise. Franchisees are also responsible for staying informed about any potential recalls and maintaining open communication channels with Bambu to ensure they receive timely notifications.
