What This Means (2025 FDD)
Based on the 2025 Franchise Disclosure Document, the franchisee is agreeing in advance to any delegation by Bambu of any portion or all of its obligations and duties under the agreement by signing the Franchise Agreement. This means Bambu can delegate its responsibilities to third parties, such as agents or independent contractors, without needing further consent from the franchisee.
This clause gives Bambu significant flexibility in managing its franchise system. For a potential franchisee, this means they may be dealing with different entities or individuals throughout the term of their agreement, depending on which responsibilities Bambu chooses to delegate. It is important to note that Bambu retains the right to delegate these obligations, and the franchisee is bound to accept such delegation.
While this delegation can streamline operations for Bambu, franchisees should be aware that the quality and consistency of support and services may vary depending on the third party involved. It is advisable for prospective franchisees to inquire about the types of obligations Bambu typically delegates and the standards it sets for those third-party providers.
