What This Means (2025 FDD)
According to the 2025 Bambu Franchise Disclosure Document, electronic signatures and delivery of signature pages are acceptable. The franchise agreement and any related documents can be executed in counterparts, and delivering a signature page via facsimile or electronic format is considered as effective as delivering a manually signed original. This allows for flexibility in the signing process, potentially speeding up the agreement execution.
The FDD states that terms like "execution," "signed," and "signature" include electronic or digital signatures. These electronic forms have the same effect, validity, and enforceability as traditional signatures, provided they comply with applicable laws. This indicates that Bambu is keeping pace with modern business practices by accepting digital methods for formalizing agreements.
For a prospective Bambu franchisee, this means they can sign and return the franchise agreement and related documents electronically, which can be more convenient than traditional methods. It's important for the franchisee to ensure that they are using secure and legally compliant methods for electronic signatures, in accordance with applicable laws, to ensure the validity of the agreement.
