What is the deadline for a Bambu franchisee to open their shoppe after signing the Franchise Agreement?

You must open your shoppe within one year after signing the Franchise Agreement. However, we may agree, in our sole discretion, to an extension of these deadlines upon a showing that you are making a diligent effort in obtaining a Franchised Location and opening the shoppe. If you fail to open your shoppe within one year, in our sole discretion, you may be required to pay us the monthly Royalty Fee and Marketing and Technology Fee. No contractual limit exists on the time it takes us to approve or disapprove your proposed location. However, we typically take no more than 10 business days to approve or disapprove your proposed location, and we may extend the deadline for opening your shoppe when circumstances beyond your reasonable control delay the site selection and approval process. According to Bambu's 2025 Franchise Disclosure Document, a franchisee must open their shoppe within one year after signing the Franchise Agreement. However, Bambu may, at its sole discretion, agree to an extension of this deadline if the franchisee demonstrates a diligent effort in obtaining a Franchised Location and opening the shoppe.
If a Bambu franchisee fails to open their shoppe within the initial one-year timeframe and an extension is not granted, Bambu may require the franchisee to pay the monthly Royalty Fee and Marketing and Technology Fee, even though the shoppe is not yet operational.
Bambu estimates that the typical length of time between signing the Franchise Agreement and opening the shoppe is approximately three to 10 months. This timeframe can be affected by factors such as securing a satisfactory site, complying with local ordinances and zoning, securing financing, obtaining a lease, upgrading or remodeling an existing location, equipment delivery schedules, recruiting and hiring, purchasing products and supplies, and completing training. The franchisee must also obtain Bambu's prior written approval before opening the shoppe and must comply with all pre-opening obligations outlined in the Franchise Agreement.
