Under what conditions can B Bops withhold approval of my proposed manager?

B_Bops Franchise · 2025 FDD

Answer from 2025 FDD Document

The Franchise Agreement requires you to devote your full-time and best efforts to the active management and operation of the Franchise, or to appoint a manager to devote such manager's full-time and best efforts to operation of the business. Although the Company recommends that you participate personally in the actual operation of your Franchise, you are entitled to appoint a full-time manager to operate the Franchise on a day-to-day basis, provided that: (1) the Company has approved the qualifications of such manager; and (2) you remain active in the business through monitoring such manager's performance in operating the Franchise. The Company will not unreasonably withhold its approval of your proposed manager, provided that such manager satisfies the Company's managerial standards and has completed the training course to the satisfaction of the Company.

What This Means (2025 FDD)

According to B Bops's 2025 Franchise Disclosure Document, while franchisees are permitted to appoint a full-time manager to oversee the daily operations, B Bops retains the right to approve the qualifications of the proposed manager. B Bops will not unreasonably withhold approval, provided the manager meets the company's managerial standards and successfully completes the required training course to B Bops's satisfaction.

This means that a prospective B Bops franchisee needs to ensure that any manager they propose meets the standards set by B Bops. These standards are not explicitly detailed in this section, but they are tied to the manager's qualifications and their performance in the training course. The franchisee also needs to remain active in the business by monitoring the manager's performance.

It is important for a potential B Bops franchisee to discuss the specific managerial standards and the content, duration, and assessment criteria of the training course with B Bops. Understanding these requirements is crucial to avoid delays or potential conflicts in getting a manager approved and ensuring smooth operation of the franchise. Additionally, the franchisee should clarify what constitutes 'active' involvement in monitoring the manager's performance to meet B Bops's expectations.
