You will be granted the right to operate the Franchise at a specific site which must be approved in writing by the Company. The site selection process will generally proceed as follows. When you apply to purchase a Franchise, you will need to execute an Application Agreement. The Company will also sign the Application Agreement and will complete Exhibit A thereto specifying the trade area in which you propose to establish your Franchise. You will thereafter be responsible for selecting and securing an acceptable site in the trade area and submitting that site to the Company for its approval. The location and approval of a site for your Franchise will be part of the application process, and it is not anticipated that a Franchise Agreement will be executed until such time as an acceptable site has been located and approved. In the event an acceptable site cannot be located and approved, your application for a Franchise will not be approved and you will be entitled to receive a refund of the deposit as described in Item 5 of this disclosure document.
