What This Means (2025 FDD)

According to B Bops's 2025 Franchise Disclosure Document, the franchisee is responsible for implementing advertising campaigns. B Bops, however, develops and provides advertising, promotional, and public relations campaigns to promote the Licensed System and Licensed Marks, using funds collected from advertising fees paid by franchisees.

The franchisee is responsible for implementing these campaigns at their own expense, as detailed in Section 10(D) of the franchise agreement. This means that while B Bops creates the advertising materials, the franchisee must execute the campaigns, bearing the costs associated with implementation.

However, B Bops is not obligated to develop or provide advertising campaigns if they have elected to waive the franchisee's advertising fee. This creates a situation where the franchisee might need to develop their own advertising if the advertising fee is waived, or if they want to supplement the advertising provided by B Bops. Franchisees are required to spend at least two percent (2%) of gross sales on independent advertising, which can include implementing B Bops' campaigns or creating their own with B Bops' approval.
