Can B Bops require indoor seating in the construction and operation of a B Bops Restaurant?

Building Design and Construction. If and when the Company approves your site, the Company will advise you whether you will be required to construct and operate a B-Bop's Restaurant with indoor seating or whether you will be required to construct and operate a B-Bop's Restaurant without indoor seating. In determining whether or not to require indoor seating, the Company will focus on a number of factors including the same factors that the Company considers in determining whether to approve a particular site as discussed above. You are solely responsible for the construction of the Franchise premises at your expense.

What This Means (2025 FDD)
According to B Bops's 2025 Franchise Disclosure Document, B Bops can require franchisees to construct and operate a restaurant with or without indoor seating. The decision to require indoor seating is made by B Bops after the franchisee's site is approved. B Bops will advise the franchisee whether indoor seating is required at that time.
B Bops determines whether or not to require indoor seating by focusing on factors considered when determining whether to approve a particular site. These factors include the size, layout and adaptability of the site to the construction of a B-Bop's Restaurant, population density, traffic patterns, location of other fast food restaurants, cost of purchasing or leasing the site, accessibility of utility and public services and similar factors.
This means that a prospective B Bops franchisee needs to be flexible regarding the restaurant design. The franchisee will not know if indoor seating is required until after the site is approved. The franchisee is responsible for the construction of the franchise premises at their own expense, so this could impact the overall investment required.
