Company shall undertake such on-site reviews as Company may in its discretion deem necessary to approve the site proposed by Franchisee for the Franchise Premises and to determine whether the Company will require Franchisee to include indoor seating in the Franchise Premises. Franchisee acknowledges and agrees that Company's approval of a site and determination of whether or not the Franchise Premises will include indoor seating shall not constitute any type of warranty by Company that such site, with or without indoor seating, will prove to be a successful location for the Franchise.
