- COMMENCEMENT OF OPERATIONS. Franchisee agrees to open and commence operation of the Franchise as soon as practicable after the effective date of this Agreement. In no event shall such opening and commencement of operations be delayed beyond eight (8) months from the effective date of this Agreement, unless an extension of time is granted in writing by Company. Where Franchisee has exhibited due diligence in complying with this Section 4, Company may, in its sole discretion, consent to an extension of the eight (8) month time period specified herein. Company shall not unreasonably withhold its consent when the delay results from circumstances beyond the reasonable control of Franchisee.

What This Means (2025 FDD)
According to B Bops's 2025 Franchise Disclosure Document, a franchisee must fulfill several requirements upon agreeing to a new location. The franchisee is responsible for securing a site for the Franchise Premises, which must receive written approval from B Bops as being suitable for a restaurant. The franchisee must secure this site at their own expense.
Following site approval, the franchisee must use B Bops's construction plans and specifications to develop the Franchise Premises. Franchisees are also obligated to open and commence operations of the franchise as soon as practicable after the agreement's effective date.
In no event can the opening and commencement of operations be delayed beyond eight months from the effective date, unless B Bops grants a written extension. If the franchisee demonstrates due diligence in complying with these requirements, B Bops may, at its discretion, consent to an extension if the delay results from circumstances beyond the franchisee's reasonable control.
