TERM OF AGREEMENT
- Developer agrees to develop B-Bop's Restaurants in the Trade Area in accordance with the following schedule (the "Development Schedule"):

Any Unit which is permanently closed by Developer after having been opened shall be deemed opened and operating for purposes of the Development Schedule only if a Unit designated as the substitute for the closed Unit is opened for operation within nine (9) months of such closing.

What This Means (2025 FDD)
According to B Bops's 2025 Franchise Disclosure Document, a Developer agrees to develop B Bops Restaurants in a specific Trade Area according to a set Development Schedule. If a B Bops Unit is permanently closed, it will still count toward the Development Schedule if a replacement Unit opens within nine months of the closure. However, this replacement Unit will not count towards fulfilling any other requirements of the Development Schedule.
This requirement ensures that Developers actively expand the B Bops brand within their designated territory according to the agreed-upon timeline. Failing to meet the Development Schedule could result in penalties or termination of the development agreement, as outlined elsewhere in the agreement.
