The continuation of your exclusive rights in the trade area are not dependent on achieving a particular sales volume or market penetration at any Franchise or on any other contingency. As noted above, however, the continuation of such rights is dependent upon your compliance with the development schedule.

What This Means (2025 FDD)

According to B Bops's 2025 Franchise Disclosure Document, for developers with multiple-unit arrangements, the continuation of exclusive rights in a trade area is dependent on compliance with the development schedule. The development schedule is negotiated between the franchisee and B Bops, and it is set forth as an appendix to the Development Agreement. So long as the developer adheres to this schedule and the Development Agreement remains in effect, B Bops and its affiliates are prohibited from establishing company-owned restaurants or granting franchises to third parties within the designated trade area.

However, upon termination of the Development Agreement, the developer's exclusive rights are rescinded. The exception to this is any exclusive territory granted for individual franchises already established. After the Development Agreement is terminated, B Bops is entitled to develop the trade area themselves or grant the right to do so to third parties.

For single-unit franchisees, the continuation of the exclusive territory is not dependent upon achieving a particular sales volume, market penetration or other similar contingency. There are no circumstances under which B Bops is entitled to modify the exclusive territory without the franchisee's consent.
