What This Means (2025 FDD)
According to B Bops's 2025 Franchise Disclosure Document, if the Franchise Premises is damaged or destroyed by fire or other casualty, the franchisee is generally responsible for restoring it to its original condition within sixty days. However, B Bops has the right to direct the restoration to proceed according to the company's then-current specifications under a specific condition.
The condition for B Bops to mandate restoration to current specifications is that the Franchise Premises can be restored in accordance with B Bops's then-current specifications without significant additional cost to the franchisee. This means that if updating the premises to the newest standards doesn't substantially increase the financial burden on the franchisee, B Bops can require the franchisee to do so.
This clause is important for prospective franchisees because it outlines the potential for B Bops to impose updated design or equipment standards following a casualty event. While the franchisee is typically only obligated to restore the premises to its original condition, this provision allows B Bops to ensure uniformity and modernization across its franchise system without placing an undue financial burden on the franchisee. Franchisees should clarify what constitutes a 'significant additional cost' to avoid potential disputes in the event of damage to the Franchise Premises.
