What This Means (2024 FDD)
The 2024 Azal Coffee Franchise Disclosure Document does not explicitly state that Azal Coffee lacks the authority to hire or fire a franchisee's employees. However, the document does state that franchisees must comply with all federal, state, and local laws, rules, regulations, and orders related to the operation of their store, including those governing their employment relationship with their employees.
This implies that the franchisee is responsible for all employment-related decisions, including hiring and firing, within their Azal Coffee franchise. The franchisee is obligated to adhere to laws such as the Fair Labor Standards Act, Title VII of the Civil Rights Act, and the Americans With Disabilities Act, which govern employment practices.
While Azal Coffee can require that a franchisee's managers complete training programs, the FDD does not grant Azal Coffee direct control over the franchisee's staffing decisions. A prospective franchisee should confirm with Azal Coffee whether they have any direct or indirect control over the hiring, firing, or management of a franchisee's employees.
