What This Means (2024 FDD)
According to Azal Coffee's 2024 Franchise Disclosure Document, a franchisee can default on their lease in a few specific ways. The Franchise Agreement requires that the franchisee's lease for the premises contain certain provisions outlined in an addendum. One key aspect is the use of the premises, which must be solely for the operation of an Azal Coffee during the entire lease term, including any renewals. If the franchisee uses the real estate for any other purpose, the landlord must notify Azal Coffee, and this will be considered an event of default.
Additionally, if the franchisee abandons the premises, it is considered a default. Abandonment is conclusively presumed if the Azal Coffee franchise is not open and fully operational for two consecutive days. This provision ensures that the location remains active and maintains the brand's presence.
These conditions are put in place to protect Azal Coffee's interests and maintain the integrity of the franchise system. By specifying the permitted use of the premises and defining abandonment, Azal Coffee aims to ensure consistent operation and prevent misuse of the franchise location. Prospective franchisees should carefully review these lease provisions and understand the implications of non-compliance.
