What This Means (2025 FDD)
According to Aw's 2025 Franchise Disclosure Document, all written notices and reports must be delivered to the most current principal business address of the party being notified. This applies to notices delivered by hand, commercial overnight courier (one business day after deposit), or U.S. Mail (three business days after placement if sent via Registered or Certified Mail, Return Receipt Requested, postage prepaid). Alternatively, notices can be sent to any other place designated by either party.
Aw may also send notices via email, provided that a hard copy of the notice is also sent by U.S. Mail on the same date as the email. All payments and reports required by the Franchise Agreement must be directed to Aw at the address of which the franchisee is notified from time to time, or to such other persons and places as Aw may direct from time to time.
For a prospective Aw franchisee, this means that it is crucial to keep Aw updated with your current principal business address to ensure timely receipt of important notices. Similarly, franchisees must adhere to Aw's specified address for payments and reports, as communicated by Aw. Failure to do so could result in missed deadlines or miscommunication, potentially leading to breaches of the Franchise Agreement.
It is also important to note that Aw retains the right to change the notification address at any time, so franchisees must pay close attention to any address updates provided by Aw. Keeping accurate records of all communications, including notices and address changes, is advisable for maintaining a clear understanding of obligations and deadlines under the Franchise Agreement.
