In the event we discontinue the Marketing Fund, we will distribute all unspent amounts existing in the Marketing Fund on the date of discontinuance to franchisees in proportion to their respective contributions for the most recent six (6) months.

What This Means (2025 FDD)
According to Aw's 2025 Franchise Disclosure Document, should Aw discontinue its Marketing Fund, any unspent amounts will be distributed to franchisees. The distribution will be proportional to each franchisee's contributions to the Marketing Fund over the most recent six months.
This means that if the Marketing Fund is discontinued, a franchisee's share of the remaining funds will depend on how much they contributed relative to other franchisees during the specified six-month period. Franchisees who contributed more during this period will receive a larger share of the unspent funds.
This policy ensures that franchisees who have recently invested more in the Marketing Fund will receive a greater return of the unspent funds if the fund is terminated. Aw retains the right to discontinue or reestablish the Marketing Fund, providing franchisees with 60 days' notice.
