Answer from 2025 FDD Document

There are currently no effective determinations of the Copyright Office (Library of Congress) or any court regarding any of the copyrighted materials. There are no agreements currently in effect which significantly limit our right to use or license the use of any copyrighted materials. There are no infringing uses actually known to us which could materially affect a franchisee's use of the copyrighted materials in any state. We are not required by any agreement to protect or defend copyrights, trade secrets or confidential information, although we intend to take whatever action, we deem necessary to protect the best interests of Papa Ray's Pizza Restaurant System.

What This Means (2025 FDD)

According to Aw's 2025 Franchise Disclosure Document, there are currently no effective determinations from the Copyright Office (Library of Congress) or any court concerning Aw's copyrighted materials. Additionally, there are no existing agreements that significantly restrict Aw's ability to use or license its copyrighted materials in any way.

This means that as of the FDD date, no legal challenges or rulings have been made against Aw regarding its copyrights. This provides some assurance to potential franchisees that Aw's copyrighted materials are not subject to any known legal disputes that could limit their use.

However, the document also states that Aw is not obligated by any agreement to protect or defend its copyrights, trade secrets, or confidential information. While Aw intends to take action to protect its interests, this lack of a binding obligation could present a risk to franchisees if Aw chooses not to vigorously defend its intellectual property. Prospective franchisees should consider the potential implications of this and discuss with Aw what specific measures they take to protect their intellectual property.
