What This Means (2025 FDD)
According to Aw's 2025 Franchise Disclosure Document, either the franchisee or Aw can waive or reduce any obligation or restriction upon the other through a written instrument. This waiver becomes effective once written notice is delivered to the other party, or on another effective date as specified in the waiver notice.
Any waiver granted by Aw is subject to continuing review and can be revoked at any time, for any reason, at Aw's sole discretion. To revoke a waiver, Aw must deliver a ten (10) day prior written notice to the franchisee.
This means that while Aw may choose to relax certain requirements for a franchisee, they retain the right to reinstate those requirements with only ten days' notice. The franchisee should therefore not rely on any waiver as a permanent change to their obligations under the franchise agreement.
