What This Means (2025 FDD)

According to Aw's 2025 Franchise Disclosure Document, to receive the annual statement of monies collected and costs incurred by the Marketing Fund, an Aw franchisee must make a written request to the company.

The Marketing Fund is administered by Aw and is used for system-wide advertising, marketing, and promotional programs. Franchisees are required to contribute a percentage of their gross revenue to this fund, as detailed in Paragraph 10.3 of the franchise agreement. Aw has sole discretion over the creative concepts, materials, and endorsements used in these programs, as well as the geographic, market, and media placement and allocation of the programs.

The Marketing Fund operates as a separate and distinct account from Aw's other funds. It is primarily used to cover the costs of advertising materials, administer advertising programs, maintain the company website, support public relations, conduct market research, and provide promotional materials to Aw restaurants. While Aw aims to use the fund to benefit all locations, there is no guarantee that expenditures in any specific area will be proportionate to the contributions from restaurants in that area. All interest earned on the Marketing Fund is applied to advertising, marketing, and promotional costs before any other assets are used.
