What agreement must managers of an Aw Papa Ray's Pizza Restaurant sign regarding confidential information?

Aw Franchise · 2025 FDD

Answer from 2025 FDD Document

You may not use our confidential information (as defined in the Franchise Agreement) in any unauthorized manner. You must take reasonable steps to prevent disclosure of our confidential information to others, including having your managers and employees sign a confidentiality agreement. All of your managers and other employees who attend our training programs, seminars or conferences and/or have access to the confidential information must maintain the confidentiality of that information and sign a confidentiality agreement in a form approved by us. You must provide us with copies of the signed confidentiality agreements before the manager or employees receives training.

What This Means (2025 FDD)

According to Aw's 2025 Franchise Disclosure Document, franchisees must ensure their managers sign a confidentiality agreement. Specifically, Aw requires franchisees to take reasonable steps to prevent the disclosure of confidential information, which includes having managers and employees sign a confidentiality agreement. This agreement must be in a form approved by Aw.

Furthermore, franchisees must provide Aw with copies of these signed confidentiality agreements before the manager or employee begins training. This requirement ensures that all individuals with access to Aw's confidential information, such as those attending training programs, seminars, or conferences, are bound by the confidentiality terms.

This is a fairly standard practice in franchising, as franchisors need to protect their proprietary information and trade secrets. The confidentiality agreement helps to ensure that sensitive information about Aw's business operations, recipes, marketing strategies, and other confidential aspects are not disclosed to competitors or used in unauthorized ways. For a prospective Aw franchisee, this means they will need to incorporate this requirement into their hiring and training processes for all managers and employees who will have access to confidential information.
