Advertising

Our Advertising. We are not obligated to conduct any advertising. We may periodically formulate, develop, produce, and conduct, at our sole discretion, advertising or promotional programs in such forms and media as we determine to be most effective. We may make available to you for you to purchase approved advertising and promotional materials, including signs, posters, collaterals, etc. that we have prepared.

What This Means (2024 FDD)

According to Auntie Annes' 2024 Franchise Disclosure Document, Auntie Annes has broad discretion over advertising and promotional programs. Auntie Annes is not obligated to conduct any advertising but may create advertising or promotional programs at its sole discretion. They also reserve the right to use any media and allocate advertising expenditures to any regions they deem appropriate.

Auntie Annes has sole authority to direct all advertising programs and promotions, including control over creative concepts, materials, and media. They administer the Ad Fund and determine how it is used. While the Auntie Anne's Franchise Advisory Council provides suggestions on advertising issues, it is advisory only and does not have decision-making authority.

Furthermore, Auntie Annes or its affiliates have the sole discretion to establish and operate various digital marketing initiatives, including websites, social media accounts, and online advertising. Unless explicitly permitted, franchisees are restricted from engaging in digital marketing that uses Auntie Annes' proprietary marks or relates to the shop. This demonstrates Auntie Annes' intent to maintain control over the brand's image and marketing strategies.
