What This Means (2024 FDD)
According to Auntie Annes's 2024 Franchise Disclosure Document, if a franchisee becomes delinquent in their dues or other payments to the Advertising Cooperative, or fails to abide by any formal agreements or authorized decisions of the Advertising Cooperative, it will be considered a failure to participate in the Advertising Cooperative. This failure is then deemed a material breach of the Franchise Agreement.
This means that consistent with standard franchise practices, Auntie Annes views participation in advertising and marketing efforts as critical for maintaining brand consistency and driving overall system sales. Franchisees are generally required to contribute to advertising funds and cooperatives to support these efforts.
For a prospective Auntie Annes franchisee, this clause highlights the importance of adhering to the financial and operational requirements of the Advertising Cooperative. Failure to do so can have serious consequences, potentially leading to termination of the franchise agreement. Franchisees should carefully review the by-laws and agreements related to the Advertising Cooperative to fully understand their obligations and avoid any potential breaches.
