How does Auntie Annes identify Approved Suppliers for Goods to be used in my Shop?

  • 5. Goods. We will furnish you with any specifications for Goods, to the extent that we publish such specifications. (Franchise Agreement, Sections 7.1. and 7.2)
  • 6. Approved Suppliers. We will identify Approved Suppliers for all Goods required to be used in the Shop and use reasonable efforts to fulfill or cause Approved Suppliers to fulfill your orders for Goods on a timely basis. If we, our affiliates, and/or our Approved Suppliers cannot supply customers (including yourself and other franchisees) with the quantity and type of Goods that they request, then we will try to allocate the available quantities and types of Goods on an equitable basis among businesses seeking to purchase the Goods. If you do not receive Goods from us, our affiliates, or our Approved Suppliers, this will not be our breach of the Franchise Agreement, nor will we, our affiliates, or our Approved Suppliers be liable to you for this. We will share with you our know-how in operating a Shop and grant you electronic or other access to our Manuals and content containing the information, methods, techniques, and specifications for the operation of a Shop. According to Auntie Annes' 2024 Franchise Disclosure Document, Auntie Annes will identify Approved Suppliers for all Goods required to be used in your Shop. Auntie Anne's also commits to using reasonable efforts to ensure these Approved Suppliers fulfill your orders for goods in a timely manner. This means that as a franchisee, you are required to purchase goods only from suppliers that Auntie Anne's has officially approved.

If Auntie Anne's, its affiliates, or its Approved Suppliers are unable to provide the quantity and type of goods requested by customers (including franchisees), Auntie Anne's will attempt to allocate the available goods equitably among those seeking to purchase them. However, if you do not receive goods from Auntie Anne's, its affiliates, or its Approved Suppliers, this is not considered a breach of the Franchise Agreement, and neither Auntie Anne's nor its suppliers will be liable to you.

After opening your Auntie Anne's franchise, Auntie Anne's will continue to identify Approved Suppliers for goods to be used in your shop. If you want to offer products or use any goods that Auntie Anne's has not approved, or purchase or lease from a supplier that Auntie Anne's has not approved, you must submit a written request for approval and provide any information that Auntie Anne's requests for review and approval or disapproval. This ensures that franchisees maintain brand consistency and quality standards by sourcing products from approved vendors, while also providing a process for franchisees to request approval for alternative suppliers or goods.
