What This Means (2024 FDD)
According to Auntie Anne's 2024 Franchise Disclosure Document, franchisees are solely responsible for negotiating the terms and fulfilling the obligations of the Site Agreement, which includes the lease, sublease, or rental agreement (Lease) or purchase agreement (Purchase Agreement) for the store location. While Auntie Anne's retains the right to review the Site Agreement to ensure compliance with their requirements, they are not obligated to do so.
This means that the franchisee bears the entire responsibility for securing a location that is both suitable for their business and financially viable. This includes negotiating rent, lease terms, and any other conditions related to the property. Franchisees should carefully consider all aspects of the Site Agreement, as they will be held accountable for meeting all its requirements.
Prospective Auntie Anne's franchisees should seek legal and real estate expertise to assist them in negotiating favorable terms and understanding their obligations under the Site Agreement. This is a critical step in setting up a successful franchise, as the location and its associated costs can significantly impact profitability.
