Are all Auntie Annes franchisees required to contribute to the Ad Fund at the same rate?
Auntie_Annes Franchise · 2024 FDDAnswer from 2024 FDD Document
We will allocate your Advertising Contributions to a fund for the advertising and promotion of the Businesses, the Marks, and the System (the "Ad Fund"). If we operate any Businesses, our Businesses will contribute to the Ad Fund in the same manner as similarly-situated Franchised Businesses. You acknowledge that our other franchisees may not be required to contribute to the Ad Fund, may be required to contribute to the Ad Fund at a different rate than you or may be required to contribute to a different advertising fund.

What This Means (2024 FDD)
According to Auntie Annes's 2024 Franchise Disclosure Document, franchisees may be required to contribute to the Ad Fund at different rates. The document states that some Auntie Annes franchisees may not be required to contribute to the Ad Fund at all, while others may contribute at a different rate than other franchisees, or they may be required to contribute to a different advertising fund altogether.
This means that the advertising contribution requirements can vary among franchisees. The amount that franchisees pay into the Ad Fund is determined by Auntie Annes. The advertising contribution, when combined with the Local Marketing Obligation, will not exceed 5% of the Net Sales of the Franchised Business. This contribution is payable each week based on the Net Sales of the Franchised Business for the preceding week.
For prospective Auntie Annes franchisees, this indicates that the specific advertising contribution rate and requirements can vary. It is important to clarify the specific obligations during the due diligence process to understand the financial commitments involved. Franchisees should also inquire about how the Ad Fund is managed and how it benefits their specific location and market, given that the franchisor has sole authority over the fund's use.
