Does an Auntie Annes franchisee have the right to demand the same variations to standards that are granted to other franchisees?

Auntie_Annes Franchise · 2024 FDD

Answer from 2024 FDD Document

You agree that complete uniformity under many varying geographic and other conditions, and over extended spans of time, is not practical and may be detrimental to the System, and that as a result: (i) we may vary the Standards for any franchisee as we deem necessary; (ii) we may grant franchises using the System under terms that may differ materially from the terms of this Agreement; and (iii) our obligations and rights with respect to our various franchisees may differ materially from our obligations and rights with respect to you, without in any way affecting our rights with respect to you.

You will have no right to require that we disclose any variation to you or that we grant you the same or a similar variation.

What This Means (2024 FDD)

According to Auntie Annes's 2024 Franchise Disclosure Document, Auntie Annes may vary the standards for any franchisee as they deem necessary. They may also grant franchises using the system under terms that may differ materially from the standard agreement. The document specifies that Auntie Annes's obligations and rights with respect to its various franchisees may differ materially from its obligations and rights with respect to a specific franchisee.

This means that as an Auntie Annes franchisee, you will not have the right to demand that Auntie Annes disclose any variations granted to other franchisees. Furthermore, you cannot demand that Auntie Annes grant you the same or a similar variation. This clause emphasizes that Auntie Annes retains significant control and flexibility in how it manages its franchise system and individual franchisees.

This lack of guaranteed uniformity could be a disadvantage for franchisees who might feel that they are not receiving the same benefits or flexibilities as others in the system. Prospective franchisees should consider this aspect carefully and discuss with Auntie Annes the conditions under which variations are granted to understand the potential implications for their own franchise operation.
