What This Means (2024 FDD)
According to Auntie Annes's 2024 Franchise Disclosure Document, after the franchise is terminated or expires, the non-competition covenant restricts involvement in a competitive business. This restriction applies for 12 months. The geographic limitations include the Accepted Location, within 3 miles of the Accepted Location, or within 3 miles of any Auntie Annes Shop. Additionally, franchisees are prohibited from diverting or attempting to divert any business from any Auntie Annes Shop.
This means that for one year after leaving the Auntie Annes system, a former franchisee cannot operate or be involved with a competing business within a defined radius of their former location or any other Auntie Annes location. This is fairly standard in franchising to protect the brand and other franchisees in the system.
The non-compete aims to prevent a former franchisee from leveraging the knowledge and customer relationships gained while operating an Auntie Annes franchise to unfairly compete with the brand. Prospective franchisees should carefully consider these restrictions, especially if they plan to remain in the same geographic area after their franchise agreement ends.
