What This Means (2024 FDD)
According to Auntie Anne's 2024 Franchise Disclosure Document, you must submit a complete set of final Architectural Plans to Auntie Anne's by the Construction Start Deadline, which is specified in Schedule A. The FDD also states that the Construction Start Deadline is within 270 days after the Effective Date. The Effective Date is specified in Schedule A of the Auntie Anne's Franchise Agreement.
In simpler terms, as an Auntie Anne's franchisee, you have 270 days from the date the Franchise Agreement goes into effect to both submit your architectural plans and begin construction. This means you need to work efficiently with your architect to develop the plans and submit them well in advance of the 270-day mark to allow for Auntie Anne's review and feedback.
Failing to meet this deadline can have serious consequences. Auntie Anne's may terminate the Franchise Agreement if you fail to meet the Construction Start Deadline and do not cure the failure within 30 calendar days after receiving notice of the default. You can request an extension before the deadline, but Auntie Anne's is not obligated to grant one and may charge a $2,500 extension fee if they agree to modify the deadline.
