What This Means (2024 FDD)

According to Auntie Annes' 2024 Franchise Disclosure Document, franchisees must employ reasonable means to safeguard the confidentiality, integrity, and security of 'Customer Information.' This information includes names, contact information, financial information, purchasing history, market research data, and other personal information relating to both current and prospective customers of the franchised business.

For a prospective Auntie Annes franchisee, this means understanding the importance of protecting customer data. Franchisees are responsible for ensuring that all customer information collected, whether directly or through third-party vendors, is furnished to Auntie Annes upon request. Auntie Annes and its affiliates also retain the right to independently access this customer information through the computer system or other means.

Franchisees are permitted to use customer information solely for marketing approved products to customers, adhering to the policies established by Auntie Annes and in compliance with applicable laws. Selling, transferring, or using customer information for any purpose beyond marketing approved products and the franchised business is strictly prohibited. Furthermore, franchisees must obtain all necessary consents and authorizations from customers, prospective customers, vendors, and others, providing all required disclosures to legally transmit customer information to Auntie Annes and its affiliates for their use.

This emphasis on data protection and usage is typical in franchising, as brands seek to maintain consistent customer experiences and leverage data for marketing and business strategy. Franchisees should be prepared to implement and maintain systems that comply with these requirements, understanding that failure to do so could result in breaches of the franchise agreement.
