What This Means (2025 FDD)

According to the 2025 Aunt Millies Bakeries FDD, Aunt Millie's is solely responsible for the content of any advertising material placed on clothing items. This agreement is part of a broader arrangement where Aunt Millie's leases space on clothing worn by the lessor's personnel to advertise Aunt Millie's products. Aunt Millie's pays $60 per week for this advertising space.

In addition to being responsible for the advertising content, Aunt Millie's also bears all expenses related to placing, amending, and removing these advertising materials. This includes the costs of designing, producing, and installing the advertisements on the clothing. The lessor, on the other hand, is responsible for maintaining the clothing in a clean and neat condition and ensuring that their personnel maintain standards of dress and personal grooming that align with Aunt Millie's clothing advertising policy.

This arrangement gives Aunt Millie's significant control over its brand image and messaging. However, it also means that Aunt Millie's bears the financial burden and creative responsibility for these advertising efforts. If the lessor fails to comply with the agreement, Aunt Millie's has the right to withhold rental payments and, if the issue is not resolved, terminate the agreement with ten days' notice, requiring the lessor to make the clothing available for the removal of advertising materials.
