What This Means (2025 FDD)
According to the 2025 Augusta Lawn Care Franchise Disclosure Document, a Principal Owner's Guaranty is included as an exhibit to the Franchise Agreement. Specifically, Exhibit C to the Franchise Agreement is the Principal Owner's Guaranty.
Furthermore, the FDD states that if the franchisee is a corporation, all officers and shareholders must approve the agreement and sign a separate Guaranty. Similarly, if the franchisee is a partnership, all general partners must approve the agreement and sign a Guaranty. If the franchisee is a limited liability company, all members must approve the agreement and sign a Guaranty. This guaranty ensures the franchisee's payments and performance of the agreement.
Augusta Lawn Care may also require a guaranty to satisfy their standards of creditworthiness or to secure the obligations made under the Franchise Agreement. This means that even if the franchisee is an individual, a guaranty may be required from another party if the franchisee's financial situation does not meet Augusta Lawn Care's standards.
