"Copyrights" means all works and materials for which we or our affiliate have secured common law or registered copyright protection and that we allow franchisees to use, sell or display in connection with the marketing and/or operation of an Augusta Lawn Care Business, whether now in existence or created in the future.
"Franchisee" means the Augusta Lawn Care franchisee for whom you are an officer, director, employee or independent contractor.
"Intellectual Property" means, collectively or individually, our Marks, Copyrights, Knowhow and System."

What This Means (2025 FDD)
According to the 2025 Augusta Lawn Care FDD, the franchise grants franchisees the right to operate an Augusta Lawn Care Business using its intellectual property. This intellectual property includes trademarks, service marks, trade names, trade dress, copyrights, know-how, and the System. Augusta Lawn Care allows franchisees to use, sell, or display copyrighted materials in connection with the marketing and operation of their franchise. The franchise agreement outlines the rights and obligations of the franchisee regarding the use of Augusta Lawn Care's intellectual property.
To protect its intellectual property, Augusta Lawn Care includes confidentiality agreements that officers, directors, managers, employees, and independent contractors of the franchisee must sign. These agreements restrict the use of the know-how and intellectual property to only the Augusta Lawn Care Business operated by the franchisee. They also require maintaining confidentiality, preventing unauthorized copies, and ceasing use of the intellectual property upon termination of their relationship with the franchisee. These measures aim to prevent unfair competition and protect the franchise system.
Upon termination of the franchise agreement, the franchisee must immediately cease using the Marks, the System, and any advertising that might give the impression of operating an Augusta Lawn Care Business. The franchisee must also take steps to remove their listings from directories and disconnect telephone numbers used in the business. Augusta Lawn Care may also require the franchisee to sign documents to delete listings and terminate references to the franchise. This ensures a clean break and prevents confusion in the marketplace after the franchise relationship ends.
