What This Means (2025 FDD)
According to the 2025 Augusta Lawn Care Franchise Disclosure Document, franchisees are required to ensure that their employees and related parties sign Nondisclosure, Nonsolicitation, and Noncompetition Agreements. These agreements must be in the form of Exhibit E, which is part of the Franchise Agreement. Franchisees must also provide Augusta Lawn Care with a copy of each signed agreement upon request.
This requirement means that if you become an Augusta Lawn Care franchisee, you will need to have your employees and any related parties (as defined in the agreement) sign these agreements to protect Augusta Lawn Care's confidential information, marketing plans, and trade secrets. This is a standard practice in franchising to safeguard the franchisor's proprietary information and prevent unfair competition.
The confidentiality obligations extend to information, ideas, forms, marketing plans, and other materials disclosed to the franchisee, whether or not included in the manual. The franchisee is responsible for ensuring their employees comply with these confidentiality provisions. This measure helps Augusta Lawn Care maintain the integrity of its business system and protect its competitive advantage.
Exhibit F to the Augusta Lawn Care Franchise Agreement provides a sample confidentiality agreement. This agreement defines terms such as "Augusta Lawn Care Business" and outlines the conditions under which the agreement is entered. This sample agreement serves as a template for the required confidentiality agreements, ensuring consistency and adherence to Augusta Lawn Care's standards.
