What This Means (2025 FDD)

According to the 2025 Augusta Lawn Care FDD, upon termination of the franchise agreement, the franchisee must promptly sign any documents and take any steps that Augusta Lawn Care deems necessary to delete the franchisee's listings from classified telephone directories, disconnect or assign all telephone numbers used in the Augusta Lawn Care business, and terminate all other references that indicate the franchisee was affiliated with Augusta Lawn Care.

To ensure these actions are taken, the franchisee irrevocably appoints Augusta Lawn Care as their attorney-in-fact to take these actions if the franchisee does not do so within seven days after termination of the agreement. The franchisee also irrevocably assigns their telephone numbers to Augusta Lawn Care.

This clause ensures that Augusta Lawn Care can quickly and effectively remove any lingering association of the former franchisee with the brand, protecting its reputation and preventing customer confusion. The attorney-in-fact provision gives Augusta Lawn Care a legal mechanism to act swiftly if a franchisee is uncooperative after termination.
