What This Means (2025 FDD)
According to Augusta Lawn Care's 2025 Franchise Disclosure Document, franchisees may face competition from outlets that Augusta Lawn Care owns. The FDD states that franchisees do not receive an exclusive territory. This means that Augusta Lawn Care can establish and operate its own outlets, or grant others the right to do so, even near a franchisee's territory.
Specifically, Augusta Lawn Care retains the right to operate an Augusta Lawn Care concept at a trade show booth within a franchisee's approved territory for up to fifteen consecutive days. They can also offer franchises to others outside the franchisee's approved territory, regardless of proximity. Augusta Lawn Care can also sell or license proprietary services from any location to any purchaser, except from an Augusta Lawn Care Business inside the approved territory.
Furthermore, Augusta Lawn Care reserves the right to develop, operate, and franchise other business concepts (except another Augusta Lawn Care Business) at any place, including within the approved territory, and use their trademarks in connection with those concepts, even if they compete with the franchisee's services. This lack of territorial exclusivity is a significant factor for potential franchisees to consider, as it directly impacts the competitive landscape they will operate in and their potential market share.
