What This Means (2025 FDD)
According to Augusta Lawn Care's 2025 Franchise Disclosure Document, while not explicitly required, franchisees are strongly encouraged to engage legal and data security professionals. This recommendation stems from the franchisee's responsibility to protect customer data and maintain compliance with Payment Card Industry Data Security Standards, as well as all applicable payment processor requirements, and state and federal laws related to data privacy and security breaches.
Augusta Lawn Care emphasizes the importance of data security by reserving the right to manage the response to any data security breach, to protect the brand's goodwill. However, Augusta Lawn Care assumes no liability for damages resulting from data breaches or actions taken in response to such breaches. Franchisees are also required to comply with the requirements of any third-party service provider that Augusta Lawn Care engages to administer a data security program.
Therefore, while Augusta Lawn Care does not mandate the engagement of legal and data security professionals, it strongly advises franchisees to seek such expertise to ensure full compliance with all relevant regulations and to adequately protect their business and customers from potential data security breaches. This recommendation highlights the importance of franchisees taking proactive measures to safeguard data and mitigate potential risks associated with data security.
