Must an Atwell Suites franchisee comply with Holiday's website requirements for any permitted websites?

Answer from 2025 FDD Document

You may not promote, implement or be responsible for any web site relating to your Hotel without Holiday's advance written approval. You may not register any of the Marks (defined in Item 13), as part of any domain name or Uniform Resource Locator ("URL"), and/or display or use any of the marks or other intellectual property rights related to the Brand System or to any of the other brands licensed by Holiday in connection with any web site, without Holiday's advance written approval. You must comply with all of Holiday's web site requirements in connection with any web sites that Holiday may permits you to develop and maintain relating to your Hotel. The License does not otherwise limit the channels through which you may solicit customers for your Hotel.

What This Means (2025 FDD)

According to the 2025 Atwell Suites Franchise Disclosure Document, franchisees must adhere to Holiday's website requirements if they are permitted to develop and maintain a website related to their hotel. Prior written approval from Holiday is required before a franchisee can promote, implement, or be responsible for any website related to their Atwell Suites hotel.

This means that while franchisees have some flexibility in marketing their specific hotel location online, Atwell Suites retains significant control over the brand's online presence. Franchisees cannot register any of the brand's marks as part of a domain name or URL, or display any intellectual property rights related to the Brand System without Holiday's advance written approval.

This requirement ensures brand consistency and quality control across all online representations of Atwell Suites hotels. It also allows Atwell Suites to manage its online reputation and marketing strategies effectively. Prospective franchisees should carefully consider these requirements and factor them into their marketing plans and budget.

It is common in franchising for franchisors to maintain control over brand-related websites to ensure consistency and protect brand reputation. Franchisees should discuss with Atwell Suites what specific website requirements exist and what support is provided for online marketing efforts.
