Answer from 2025 FDD Document

Hotel agrees that FreedomPay shall have no liability or obligation to Hotel for any transactions not submitted or reported to FreedomPay for settlement within sixty (60) days after the actual date of the transaction.

For transactions submitted or reported after such time limit, FreedomPay will attempt to settle such transactions if the data is available, but FreedomPay will have no liability to Hotel if it is unable to settle such transactions.

What This Means (2025 FDD)

According to Atwell Suites's 2025 Franchise Disclosure Document, an Atwell Suites hotel must submit transactions to FreedomPay for settlement within sixty (60) days after the actual date of the transaction. If a transaction is submitted after this 60-day period, FreedomPay is not obligated or liable to settle the transaction.

While FreedomPay will attempt to settle transactions submitted after the 60-day deadline if the data is available, Atwell Suites hotels cannot rely on this. To avoid potential non-settlement, franchisees must ensure timely submission of all transactions. This requirement underscores the importance of efficient and accurate transaction processing and reporting procedures at the hotel level.

This policy protects FreedomPay from liability for stale transactions where data may no longer be readily available or verifiable. For an Atwell Suites franchisee, this means implementing robust accounting and reconciliation practices to ensure all transactions are captured and submitted within the specified timeframe. Failure to do so could result in a loss of revenue if FreedomPay is unable to settle the late transactions.
