What This Means (2025 FDD)
According to Atwell Suites's 2025 Franchise Disclosure Document, franchisees (referred to as 'Hotel' in this context) are explicitly restricted from making any alterations or improvements to the Secure Payment Solution equipment without prior written approval from the manufacturer. This requirement ensures that the equipment remains compliant with the manufacturer's specifications and that any changes do not compromise the system's functionality or security.
This restriction has important implications for Atwell Suites franchisees. It means that franchisees cannot independently modify the payment systems to suit their specific needs or preferences. Any desired changes or improvements must be proposed to the manufacturer and approved in writing, which could potentially involve a lengthy process and additional costs.
The FDD also states that the franchisee must ensure the equipment is kept in good working condition, with normal wear and tear excepted, and that they operate and maintain the equipment according to the user manuals and any instructions issued by the manufacturer. This reinforces the franchisee's responsibility to properly care for the equipment while adhering strictly to the manufacturer's guidelines and limitations on modifications. Failing to comply with these terms could result in a breach of the franchise agreement and potential penalties.
