FRANCHISEE may delegate the day-to-day, on-premises management to a full-time manager who has successfully completed FRANCHISOR'S initial training program (or other training as specifically designated by FRANCHISOR). FRANCHISEE shall keep FRANCHISOR informed at all times of the identity of any employee(s) acting as manager(s) of the Franchised Business. All managers of the Franchised Business employed by FRANCHISEE shall complete the initial training program specified in Section 6.B (unless otherwise agreed upon in writing by FRANCHISOR) at such costs as specified therein. FRANCHISEE shall cause each such manager to sign a Confidentiality and Non-Disclosure Agreement in a form approved by FRANCHISOR and FRANCHISEE shall submit a copy of such agreement to FRANCHISOR within thirty (30) days after execution by the applicable manager. Notwithstanding the delegation of day-to-day operations, FRANCHISEE shall remain ultimately responsible for the operation of the Franchised Business and for supervising all managers. FRANCHISEE shall, at all times, faithfully, honestly and diligently perform its obligations hereunder and shall not engage in any business or other activities that will conflict with its obligations hereunder.

What This Means (2025 FDD)
According to Apricot Lane's 2025 Franchise Disclosure Document, if a franchisee wishes to delegate day-to-day management of their store to a manager, that manager must first successfully complete Apricot Lane's initial training program. Alternatively, the franchisor may designate other specific training in writing as acceptable. The franchisee must keep Apricot Lane informed of the identity of any employee acting as a manager.
All managers employed by the franchisee are required to complete the initial training program, unless Apricot Lane agrees otherwise in writing. The costs associated with this training are specified in Section 6.B of the FDD. Additionally, each manager must sign a Confidentiality and Non-Disclosure Agreement in a form approved by Apricot Lane, and the franchisee must submit a copy of this agreement to Apricot Lane within 30 days of its execution.
Even with the delegation of daily operations to a manager, the franchisee remains ultimately responsible for the overall operation of the Apricot Lane franchise and for supervising all managers. The franchisee is expected to faithfully, honestly, and diligently perform their obligations and must not engage in any business or activities that conflict with their obligations under the franchise agreement.
