C. Failure to Complete Training

What This Means (2025 FDD)

According to the 2025 Apricot Lane FDD, Section C of Item 23 discusses the repercussions of failing to complete the initial training program. Apricot Lane requires that the franchisee or their designated manager complete the initial training to the franchisor's satisfaction. This determination is made at Apricot Lane's sole discretion.

If the franchisee or their manager does not fulfill this training obligation, Apricot Lane has the right to terminate the franchise agreement. In the event of termination, Apricot Lane can elect to assume the lease for the franchised premises and/or purchase all furniture, fixtures, and other assets of the franchised business at a cost agreed upon by both parties.

If the agreement is terminated due to failure to complete training, Apricot Lane will return the franchise fees paid by the franchisee, minus expenses incurred by Apricot Lane in connection with the agreement and its performance. However, this refund is contingent upon the franchisee executing a general release of any claims against Apricot Lane and related parties, and returning all copies of proprietary materials and confidential information to Apricot Lane.
