It is your responsibility to prepare all required construction plans and specifications to suit the Premises. FRANCHISOR does not, and will not, assume any liability or be deemed liable for any agreements, representations or warranties made by and between FRANCHISEE and any third party relating to such construction plans and specifications. What This Means (2025 FDD)
According to the 2025 Apricot Lane FDD, while the document mentions the Americans with Disabilities Act (ADA), it does not specify a particular chapter in the Confidential Operations Manual that discusses ADA regulations. Instead, the FDD emphasizes the franchisee's responsibility to ensure compliance with the ADA when preparing construction plans and specifications for the premises.
The FDD states that Apricot Lane does not assume liability for agreements between the franchisee and third parties regarding construction plans. Any review by Apricot Lane of the franchisee's construction plans is limited to ensuring compliance with their design requirements and the franchise agreement, not with federal, state, or local laws like the ADA.
Therefore, it is crucial for prospective Apricot Lane franchisees to consult with legal and construction professionals to ensure full compliance with ADA regulations during the construction and operation of their store. Franchisees should ask Apricot Lane for any available resources or guidelines related to ADA compliance, even if it is not a specific chapter in the manual.
