C. Marketing and Advertising
Upon commencement of operation of the Franchised Business, and during the term of this Agreement, FRANCHISOR shall review and approve all advertising and promotional materials to be used in the operation of the Franchised Business.
D. Operations Advice

- FRANCHISOR may from time to time advise FRANCHISEE of its observations relating to the operation of the Franchised Business as disclosed by reports and information submitted to FRANCHISOR or by inspections or audits conducted by FRANCHISOR or its agents of the Franchised Business, provided that FRANCHISOR shall not be liable to FRANCHISEE for failure to recognize or report any problems to FRANCHISEE and does not hereby assume any responsibility for the operation of the Franchised Business. Operations advice may address any matters relevant to the operation of the Franchised Business, for example:

According to the 2025 Apricot Lane Franchise Disclosure Document, Apricot Lane may offer advice to franchisees regarding the operation of their franchised businesses. This advice is based on reports, information submitted to Apricot Lane, or inspections and audits conducted by Apricot Lane or its agents. However, Apricot Lane explicitly states that it is not liable to the franchisee for failing to recognize or report any problems and does not assume responsibility for the business's operation through this advice.
Apricot Lane may also conduct field visits to the franchised business at the franchisee's request. However, these visits are at Apricot Lane's discretion, and the franchisee may be required to cover all travel and related expenses associated with the visit, as well as provide additional information upon request.
Furthermore, Apricot Lane states that it is not liable to franchisees or any third parties by virtue of any approvals, advice, or services provided to the franchisee, to which Apricot Lane would not otherwise be subject. This reinforces that while Apricot Lane offers support and advice, the ultimate responsibility for the operation and success of the Apricot Lane franchise lies with the franchisee.
