What This Means (2024 FDD)
According to Aplus's 2024 Franchise Disclosure Document, to change the address where notices are delivered, you must provide Aplus with written notice of the change. This written notice must be delivered to Aplus in a specific manner.
The FDD specifies that all notices or demands must be in writing and can be served in person, by Express Mail, by certified mail, by private overnight delivery, or by facsimile or other electronic system. The notice is considered delivered at the time of service if personally served; 24 hours after deposit in the U.S. mail (excluding weekends and national holidays) if sent by Express Mail; upon actual receipt or three calendar days after deposit in the U.S. mail with return receipt requested if sent by certified mail; 24 hours after delivery if sent by private overnight delivery; and at the time of transmission by facsimile if sent before 5:00 p.m. on a business day, provided a copy is mailed within 24 hours after transmission.
Initially, notices and demands should be sent to the addresses listed on the Summary Pages of the Development Agreement. By adhering to the outlined notification procedure, either party can ensure that any changes to their address for receiving official communications are properly documented and acknowledged under the terms of the Aplus Development Agreement.
