What This Means (2024 FDD)
According to the 2024 Aplus Franchise Disclosure Document, a franchisee has 30 days after the termination or expiration of their franchise agreement to provide Aplus with evidence of compliance regarding the cancellation or assignment of any assumed names. This obligation ensures that the franchisee takes the necessary steps to relinquish any assumed names or registrations containing the Aplus name or marks.
Specifically, the franchisee must take action to either cancel or assign any assumed name or equivalent registration filed with state, city, or county authorities that includes the name "APLUS" or any other Aplus mark. The franchisee must then furnish Aplus with evidence that is satisfactory to Aplus, demonstrating that they have complied with this requirement. This evidence must be provided within thirty days after the termination or expiration of the franchise agreement.
This requirement is important for protecting Aplus's brand and preventing confusion in the marketplace. By ensuring that former franchisees properly cancel or assign assumed names, Aplus can maintain control over its trademarks and prevent unauthorized use of its brand. Franchisees should be aware of this obligation and take the necessary steps to comply with it in a timely manner to avoid any potential legal issues or disputes with Aplus.
