What This Means (2024 FDD)

According to Aplus's 2024 Franchise Disclosure Document, Aplus is not restricted from owning, acquiring, establishing, operating, or granting franchise rights for other businesses under different trademarks or service marks, even if those businesses are the same as or competitive with Aplus stores. Aplus also reserves the right to own, operate, or franchise businesses offering different products or services than those in the Franchise Agreement under the Aplus or Sunoco name, or a derivative of those marks. This means that Aplus could potentially introduce competing brands or concepts into the market, which could impact an Aplus franchisee's business.

This lack of restriction could pose a risk to franchisees, as Aplus could introduce new brands or concepts that directly compete with existing Aplus locations. While Aplus retains the flexibility to diversify and explore new business opportunities, franchisees should be aware of the potential for increased competition from the franchisor itself. This is a fairly common practice in the franchise industry, as franchisors often seek to expand their reach through multiple brands.

Prospective franchisees should consider this aspect carefully and evaluate the potential impact of such competition on their investment. It would be prudent to discuss Aplus's long-term business strategies and potential future ventures with the franchisor to gain a better understanding of their plans and how they might affect the Aplus franchise system. Understanding Aplus's intentions can help a franchisee assess the potential risks and rewards of investing in an Aplus franchise.
