What This Means (2024 FDD)
Based on the 2024 Aplus Franchise Disclosure Document, there is no specific section outlining a franchisee's direct obligation to ensure their employees, managers, officers, agents, and representatives actively work to enhance the Aplus system or sales. However, the FDD does state that the franchisee must operate the Franchised Business so that it is clearly identified and advertised as an APLUS Store and that the franchisee shall use the trademark "APLUS" and the other Marks which now or hereafter may form a part of the System, on all signs, suppliers, business cards, uniforms, advertising materials, Technology platforms, signs and other articles in the identical combination and manner as the Franchisor may prescribe in writing and Franchisee shallsupply to the Franchisorsamples and photographs of the same upon Franchisor's request. Franchisee shall comply with all trademark, trade name, service mark and copyright notice marking requirements and Franchisee shall ssupply to the Franchisor samples or photographs upon Franchisor's request.
Item 23, Section 13.20, states that the franchisee must comply with all applicable federal, state, and local laws, rules, regulations, ordinances, and orders. It is the franchisee's sole responsibility to understand and adhere to these laws. Failure to comply is a material breach of the agreement, potentially leading to termination.
While the FDD does not explicitly require franchisees to ensure their staff actively enhance the Aplus system, franchisees are required to ensure their staff is familiar with the Aplus system and standards. Prospective franchisees should clarify with Aplus the specific expectations regarding employee contributions to system improvement and sales enhancement, as these may be communicated through other channels such as training or operational manuals.
