What This Means (2024 FDD)
According to Aplus's 2024 Franchise Disclosure Document, a franchisee has a maximum of five business days to maintain all required professional licenses, permits, and certifications. Failure to do so for a period exceeding this timeframe constitutes an incurable default under the Franchise Agreement. This means that Aplus has the right to terminate the agreement immediately upon delivery of a termination notice, without providing the franchisee an opportunity to rectify the situation.
This provision is significant because it highlights the critical importance of maintaining compliance with all regulatory requirements for operating the Aplus franchised business. Unlike other defaults that may allow a cure period, this particular failure results in immediate termination, emphasizing the potential severity of non-compliance.
For a prospective franchisee, this underscores the need to have robust systems in place to ensure all licenses, permits, and certifications are kept current and valid. It also means understanding the specific requirements in their local jurisdiction and proactively managing renewals and updates to avoid any lapse. Failing to do so could result in the loss of their franchise.
