11. ADVERTISING AND PROMOTIONAL ACTIVITIES

11.1. Marketing Fee.

What This Means (2024 FDD)

According to Aplus's 2024 Franchise Disclosure Document, the Marketing Fee is due monthly on the tenth (10th) of the month. The payment method should be the same as the Royalty Fee.

The Marketing Fee is capped at the lesser of $1,500 or 2% of monthly Gross Sales. Currently, the marketing fee is $750 per month. Aplus will provide at least 30 days' notice before changing the Marketing Fee requirements.

If the Marketing Fees are not received by Aplus on the due date, they will be subject to interest charges at the highest rate allowed by applicable state law. Interest will accrue from the date the payment was due until it is received in full. The franchisee is also responsible for covering all costs Aplus incurs while collecting any unpaid and past due amounts, including reasonable collection or attorney fees.

Aplus has the right to apply any payments made by the franchisee to any past due amounts, including Royalty Fees, Marketing Fees, Technology Fees, or purchases from Aplus or its affiliates. This means that if a franchisee has outstanding debts, Aplus can allocate payments to those debts regardless of what the franchisee designates the payment for.
